What began as a targeted effort focused largely on apparel, cotton, and consumer goods has evolved into a far broader compliance regime affecting industrial manufacturers, raw\u2011material importers, and complex multi\u2011tier supply chains.<\/p>\n\n\n\n<p>In 2026, forced\u2011labor enforcement is no longer confined to what is visible at the point of import. It is increasingly directed at <strong>inputs<\/strong>, <strong>intermediate goods<\/strong>, and <strong>upstream processing stages<\/strong>, often far removed from the final product entering the United States. For logistics, sourcing, and trade compliance professionals, this shift materially changes how risk must be assessed, documented, and managed.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">From Consumer Goods to Industrial Inputs<\/h3>\n\n\n\n<p>The most consequential development came with the 2025 update to the UFLPA enforcement strategy. The Forced Labor Enforcement Task Force (FLETF) added several <strong>new high\u2011priority sectors<\/strong>, including lithium, copper, steel, caustic soda, and agricultural products such as jujubes (U.S. Trade Representative, 2025). These sectors were selected based on evidence of state\u2011linked labor programs and the Xinjiang region\u2019s role in global production.<\/p>\n\n\n\n<p>This expansion matters because these materials are foundational. Lithium feeds battery manufacturing. Copper and steel underpin infrastructure, automotive, and machinery production. Caustic soda is essential to chemicals and refining. The law operates on a <strong>rebuttable presumption<\/strong>: goods mined, produced, or manufactured wholly or in part in Xinjiang, or by entities on the UFLPA Entity List, are presumed to be made with forced labor and therefore inadmissible.<\/p>\n\n\n\n<p>To overcome that presumption, importers must provide \u201cclear and convincing evidence\u201d that forced labor was not involved. In practice, this standard has proven extremely difficult to meet. According to U.S. Customs and Border Protection (CBP), more than 16,000 shipments valued at nearly $3.7 billion have been subjected to UFLPA review since enforcement began (CBP, 2026).<\/p>\n\n\n\n<p>Crucially, CBP does not need to prove forced labor occurred.
